1. Agreement to Terms

By accessing or using Afronighty (the "Service"), operated by Afronighty Corp. ("Company," "we," "us," or "our"), a company registered in the United Arab Emirates, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

To use Afronighty, you must:

• Be at least 18 years old. This is a strict requirement. By using the Service, you represent and warrant that you are at least 18 years of age.
• Be legally permitted to use the Service under the laws of your jurisdiction
• Not be prohibited from using the Service under any applicable law
• Not have been previously banned or removed from the Service
• Create only one account per person

3. Your Account

When you create an account with us, you must provide accurate, complete, and current information. You agree to:

• Provide truthful information about yourself
• Use only your own photos that accurately represent your current appearance
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with anyone

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may NOT:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, stalk, threaten, or otherwise violate the rights of others
• Post content that is hateful, discriminatory, violent, or sexually explicit
• Impersonate any person or entity or misrepresent your affiliation
• Post false or misleading information
• Solicit money or other valuables from other users
• Advertise or promote products, services, or commercial activities
• Collect or harvest user data without consent
• Transmit viruses, malware, or any harmful code
• Use automated systems (bots, scrapers) to access the Service
• Attempt to interfere with or disrupt the Service
• Use the Service for prostitution or escort services

5. User Content

You are solely responsible for the content you post on Afronighty ("User Content"). By posting content, you:

• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service
• Represent that you own or have the rights to use the content you post
• Agree that your content does not violate the rights of any third party
• Understand that we may remove any content that violates these Terms

We reserve the right to remove any User Content at our sole discretion, without notice, for any reason.

6. Subscriptions and Payments

Some features of Afronighty require a paid subscription:

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• Payments are processed securely through LemonSqueezy
• You can cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial subscription periods
• Prices may change with notice; continued use constitutes acceptance of new prices

7. Safety and Interactions

Important: While we strive to create a safe environment, we cannot guarantee the behavior of other users. You acknowledge that:

• You are solely responsible for your interactions with other users
• We do not conduct criminal background checks on users
• We cannot verify the identity or intentions of all users
• You should exercise caution when meeting people in person
• You should report any suspicious or harmful behavior immediately

8. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the Service
• Fraudulent or illegal activity
• Request by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the app settings.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW:

• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We do not guarantee the Service will be uninterrupted, secure, or error-free
• We do not guarantee any specific results from using the Service
• We are not responsible for the conduct of any user, whether online or offline

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFRONIGHTY CORP. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Dubai, UAE.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
